General contractual conditions

regarding the purchase of tickets and the museum visits

Effective from 22 August 2023

 

These General Terms and Conditions (“GTC“) include the rules for the purchase of tickets for visiting the Light Art Museum Budapest (1054 Budapest, Hold utca 13.) operated byINTERSPUTNIK Rendezvényszervező és Szolgáltató Kft. (registered office: 1054 Budapest, Széchenyi rakpart 7. 2. emelet, 23, tax number: 14335941-2-41), as a service provider (“Service Provider“) and for visiting the exhibitions of the museum; accordingly, the legal relationship between the Service Provider and the Ticket Purchaser, Ticket Holder and Visitor defined in Section 2 below and the respective rights and obligations.

Please read this document carefully before finalizing your order and attending our museum, because by finalizing your order and attending our museum you accept the contents of these GTC!

Please use our services only if you agree with all points and accept to be bound by them. These Terms and Conditions are concluded in Hungarian/English at the Visitor’s choice, are not registered and are concluded in electronic form only (they are not considered as a written contract).

The GTC as amended from time to time, the specific terms and conditions for other products and services, the policies of each exhibition that form part of these GTC, and the Privacy Policy that form part of these GTC and its annexes are available for viewing, printing and downloading at https://lam.xyz/terms-conditions/ and its sub-pages, and can be found at the venue of the event.

The Service Provider may review and amend the GTC from time to time.

2. Definitions

2.1. Service provider: INTERSPUTNIK Kft.

2.2. Museum:LAM (Light Art Museum Budapest) operated by the Service Provider.

2.3. Exhibition: exhibition, tour or guided tour services on the LAM site, either together or separately.

2.4. Visitor: a natural person who is admitted to a museum exhibition or guided tour.

2.5. Ticket Purchaser: the person who purchases the Ticket from the Service Provider.

2.6. Ticket Holder: the Ticket Purchaser or the person to whom the Ticket has been lawfully transferred.

2.7. Consumer: a natural person acting outside his/her profession, independent occupation or business activity within the meaning of Section 8:1 (1) 3) of Act V of 2013 on the Civil Code (hereinafter referred to as the “Civil Code“) and Section 2 a) of Act CLV of 1997 on Consumer Protection; in particular: the Ticket Purchaser.

2.8. Ticket: a certificate of presentation in any form (printed or electronic) with a unique identifier, which must be presented at the time of entry (access wristband) and which represents the right to access to the Exhibition organised by the Service Provider.

2.9. Voucher: a presentation certificate issued by the Service Provider in any form (printed or electronic) entitling the holder to obtain a Ticket and bearing a unique identifier (QR code), which must be presented at the time of entry.

2.10. Coupon: code offering a discount on the purchase of a Ticket.

2.11. Gift Voucher: a pre-redeemed voucher entitling the holder to purchase a Ticket and transferable to third parties.

2.12. Rules of Conduct: documents annexed to the T&Cs, which are available on the LAM Website and its sub-pages and on the premises, and which include the rules of entry and conduct applicable to the Exhibitions, partly a brief summary of the provisions contained in these T&Cs and partly mandatory provisions specific to each Exhibition, established in the light of the circumstances of the Exhibition.

2.13. Card payment partner: primarily the Stripe payment system, an independent company other than the Service Provider. The Stripe payment system’s terms and conditions and privacy notice are available on an ongoing basis at https://stripe.com. Secondary payment partner is the online payment system SimplePay, developed and operated by OTP Mobil Ltd., whose general terms and conditions for customers are available at https://simplepay.hu/vasarlo-aff/ .

2.14. Website: the website located at https://lam.xyz

 

3. General provisions

3.1 All agreements contained in these GTC apply to the legal relationship between the Ticket Purchasers, Ticket Holders and Visitors and the Service Provider for the purpose of attending the Museum exhibitions. Any amendment or deviation from them may only be made based on individual written agreements signed by the parties.

3.2 The exhibition is open to natural persons of all ages, but minors must be accompanied by an adult over the age of 18. The exhibition can only be visited during the times booked in advance or at the Museum (typically in 60-minute time zones).

3.3. By entering the Exhibitions venue, Visitors accept the contents of the GTC as binding upon them. The Ticket Purchaser (by purchasing the Ticket), the person other than the Ticket Purchaser who is the Ticket Holder (by lawfully acquiring the Ticket) the Visitor (if he/she was not previously the Ticket Holder, by entering the Exhibitions venue) accepts the contents of these GTC as binding upon him/her.

 

4. Prices, tickets

4.1 The price published by the Service Provider on the day of placing the order on the https://lam.xyz or spartybooking.com website is valid for the purchase of Tickets, all other prices – indicated previously or by other sources, in particular in publications for marketing purposes – are for information purposes only. For all products or services, the gross price is indicated, including all taxes and charges. The amount to be paid by the Ticket Purchaser is the current purchase price of the product/service in question, including the effective VAT (27% as of now) and is clearly indicated in the “payment summary” which is displayed before the order is placed.

4.2 Prices on the https://lam.xyz Website are quoted in HUF., EUR, or other currencies. In the case of purchase/payment in other currencies, the amount payable will be converted at the exchange rate applied by the Card Payment Partner.

4.3 Tickets for exhibitions can be purchased online and on the spot. The prices of tickets purchased online and at the Museum may differ.

Online ticket sales will be closed (sold-out) after a certain number of Tickets have been sold, after which individual tickets can only be purchased at the Exhibition venue. Online payment is possible by credit card.

4.4. Procedure in case of incorrect price

The indication of:

-0 EUR price,

-a price reduced by the discount but incorrectly indicating the discount (e.g. a product of EUR 100 offered for EUR 10 with 50% discount indicated).

is considered to be an manifestly incorrect price indication,

In the event of an incorrect price indication, the Service Provider offers the possibility to purchase the product at the real price; aware of that, the Ticket Purchaser may decide whether to order the product at the real price or to withdraw from the Contract without any adverse legal consequences.

4.4 The Service Provider reserves the right to change the Ticket Prices at any time, but the right to change the Ticket Prices does not apply to Tickets purchased under existing Contracts.

4.5 Ancillary services, food and beverages at the Exhibition venue are subject to a separate charge and payment.

4.6. Tickets are transferable. In the event of a transfer of a Ticket, the Ticket Holder accepts these GTC by accepting the Ticket. The commercial marketing or resale of the Ticket for commercial purposes is prohibited.

 

5. How to order (buy tickets) online

5.1 The Service Provider accepts orders placed online through the sales system of the Website (as well as throughcontracted resellers).

5.2 A Ticket can only be ordered in the quantity corresponding to the multiple specified next to the Ticket type.

5.3 Please note that the information on the Service Provider’s Website about products and services, including their prices, is for information purposes only. Any order placed by the Ticket Purchaser (Consumer) on the basis of this information constitutes an offer under the Civil Code, the acceptance of which by the Service Provider is a condition for the conclusion of the contract. After receipt of the offer, the Ticket Purchaser will be sent without delay an acknowledgement of receipt of the offer, and – after successful payment – the acceptance of the offer and the Voucher. The Contract between the Ticket Purchaser and the Service Provider is concluded upon acceptance of the offer by the Service Provider. The Service Provider shall notify the Consumer of the acceptance of the offer by e-mail immediately after the offer has been made, but no later than within 1 working day, and shall inform the Consumer in this e-mail of the possibility to download the Voucher.

5.4 Placing an order does not in itself bind the Service Provider, and the absence of a response does not constitute implicit acceptance of the order.

 

6. The steps to order online:

6.1 Orders can be placed by the Ticket Purchaser via the shopping interface available on the website.

To place an order, you must first select the type of tour you wish to book (without guided tour/guided tour), together with the date (year, month, day), and then select the type of ticket you wish to buy.

Adult/Pensioner/Child/Family – 2 adults and 2 children under 12 years of age). The Ticket entitles to a 60-minute visit. Free for children under 4 years.

After that, the number of tickets of the given ticket type that the Ticket Purchaser wishes to add to the cart must be indicated.

When you click on the cart, the contents of the cart must be checked. If the contents of the cart are correct, click on the “Proceed to checkout” button to proceed to enter your personal and billing details.

6.2 The Ticket Purchaser will then be redirected to the Card Payment Partner’s web interface, where payment is only possible by credit card. The purchase process can be interrupted at any time before the payment is made, without any consequences. In case of successful payment, the Ticket Purchaser will be returned to the Website where he/she can download the Voucher(s) and at the same time, but no later than within one business day, will be notified by e-mail of the successful payment and will receive the Tickets as an attached PDF, together with the order confirmation. The cost incurred by the Ticket Purchaser in respect of the electronic payment service shall be borne by the Ticket Purchaser.

6.3 Service providerwill issue only electronic invoices through the payment, which will be issued to the name provided by the Ticket Purchaser or to the name of the company indicated during the invoicing process, provided that the company name / EU VAT box is filled in. The electronic invoice will be sent by e-mail.

The Voucher(s) must be printed out by the Visitor and brought to the Exhibition, where they will be converted into Ticket(s) by the Service Provider by scanning the barcodes on the spot.

6.4 It is the sole responsibility of the Ticket Purchaser to deliver the Voucher to the Visitor(s).

 

7. How to check and correct data entry errors

7.1 The order data can be edited/revised during the order process, throughout the entire time of the process, until the order is placed. During the ordering process, the Ticket Purchaser has the possibility to modify the data entered by him/her at any time before the order is finalised (by clicking on the back button in the browser, the previous page will be opened, so the data entered can be corrected even if the Ticket Purchaser has already moved to the next page). Please note that it is the Ticket Purchaser’s responsibility to ensure that the data entered by him/her are entered accurately, as the invoice will be issued on the basis of the data entered.

7.2 The Service Provider shall not be liable for performance based on inaccurate data entry. Please note that an incorrectly entered e-mail address or the fullness of the storage space belonging to the mailbox may result in non-delivery of the confirmation and, in some cases, may prevent the conclusion of the Contract.

7.3. The Service Provider reminds the Ticket Purchasers that if they do not receive a confirmation, they should check whether the email containing the Ticket has been replaced to the spam folder; or, if they have not received the Ticket but only the invoice confirming the purchase, they should immediately report it.

 

8. Methods of payment

8.1 The value of the services provided by the Service Provider and sold online can only be paid by credit card, using the system of the Card Payment Partner selected by the Ticket Buyer on the Website. The Service Provider shall not access, record or store the data provided by the Ticket Purchaser during the payment process and used by the Card Payment Partner for payment.

8.2. Optional payment methods:

8.3 The Service Provider excludes the exchange, redemption or refund of the Tickets purchased, except if the Exhibition is cancelled for reasons solely within the sphere of interest of the Service Provider. In case of possible cancellation of the Exhibition, the Service Provider will offer the possibility of rebooking the Ticket and, if the Ticket Purchaser does not make use of the rebooking option, the Service Provider will refund the Ticket price (excluding the transaction fee). The Ticket price will be refunded to the credit card used by the Ticket Purchaser to purchase the Tickets, through the card payment service provider used for payment.

 

9. Participation in the Exhibition

9.1 Visitors are entitled to participate in the Event in accordance with the Service Provider’s current Policies (https://lam.xyz/rules) and the specific rules eventually issued in respect of individual Exhibition. Moreover, the Service Provider reserves the right to check the access authorization of persons staying on the Exhibition premises (possession of e.g., an access wristband) at all times on site.

9.2 The price of the Ticket includes entry and, depending on the type of Ticket selected, access to an individual locker/changing room where the Visitor can store his/her belongings.

9.3 Violation of the Policies and Regulations may result in the unilateral suspension of participation in the Exhibition, in which case the Visitor shall not be entitled to any compensation or refund.

 

10. Entry to the Exhibition. Warranty and liability provisions

10.1 The Service Provider warrants that the Visitor can enter the Exhibition with a Ticket received for the corresponding, validly held Voucher; however, the Service Provider does not guarantee the length of the admission process (i.e. the time required to convert the Voucher into a Ticket and to enter the Exhibition with the Ticket) in view of the possible high attendance. The Service Provider reserves the right, in exceptional cases, to block certain areas of the Museum site and at the Exhibition from the Visitors for technical, safety, artistic or other unforeseen reasons.

The Service Provider draws your attention to the fact that due to the architectural characteristics of the listed building, parts of the interior are not accessible to the public; in this regard the Service Provider expressly excludes its liability to refund, give a subsequent discount, compensate, indemnify or pay any compensation to the Visitor for these reasons.

10.2 Within the Exhibition, the Service Provider is entitled to unilaterally change the time of the pre-announced program items, the exhibitors (e.g., the Service Provider expressly reserves the right to make changes ). The Service Provider also reserves the right to modify, adapt and improve the Exhibition, the services and the program provided therein, as necessary and at its discretion. The Visitor shall not be entitled to assert any claim or demand against the Service Provider in connection with such modifications, alterations or improvements.

10.3 In the exhibitionof cancellation of the Exhibitionfor reasons other than force majeure as set out in Clause 13 of the GTC, i.e. if the Museum is closed , the Service Provider shall ensure the redemption of the Tickets. The Service Provider shall inform the Visitor on the cancellation of the Exhibition and the fact that the Museum is closed immediately after becoming aware of it, by means of a notice published on the Website. The Service Provider shall not be liable for any damages resulting from the failure to get such information.

If the Exhibition does not take place on the date announced in advance, the Ticket purchased will still entitle the Visitor to enter the Exhibition on the new date, but the Visitor is entitled to redeem the Ticket with regard to the change of date. The Ticket may be redeemed only at the times specified by the Service Provider, but not later than within 30 (thirty) days of the date of the cancelled Exhibition, in case of cancellation of the Exhibition.

10.4 The Service Provider is entitled to use subcontractors for the performance of the Contract. The Service Provider shall be liable for the activities of subcontractors as if it had acted itself.

The Visitor also acknowledges that products and services may be purchased in connection with the Exhibition that are not provided by the Service Provider or its contributor partners, but by other contractual partners as third parties. In such cases, the contract shall be concluded directly between the Visitor and such third party, and the rights and obligations arising from the legal relationship shall be directly vested in and binding upon them. The Visitor expressly acknowledges that he/she may not assert any claims against the Service Provider in connection with such Products and Services or the legal relationship relating to them. The Service Provider also states in general that it does not assume any liability in connection with the Products and Services provided by its contractual partners. The services and products provided by the contractual partners may be used by the Visitor solely at his/her own risk. Furthermore, the Service Provider does not assume any liability for damages caused or suffered in connection with the use of the services and products provided by the contractual partners.

10.5 The Visitor may visit the Exhibition only at his/her own risk, taking into account his/her own health condition. The Visitor acknowledges that the Exhibition may be subject to strong sound or light effects and that certain parts of the Exhibition space are not illuminated. The Service Provider shall be liable only for intentional breach of contract attributable to the Service Provider, and breaches causing damage to human life, personal injury or health damage, and excludes its liability for any other damage, including damage to human life, personal injury, health or property damages, beyond the rights expressly granted to the Visitor by law. The price of the Ticket has been determined with respect to the foregoing exclusions. The Service Provider shall not be liable for objects placed in the cloakroom at the Exhibition venue.

10.6 In order to ensure the safe conduct of the Exhibition, the Service Provider reserves the right to specify in the Policies the objects and equipment that may be brought into the Exhibition area and to restrict their entry during the admission process at the Exhibition venue. Food, beverages and tobacco products may be brought into the Exhibition area only to the extent and in the quantities permitted by the Exhibition Policies. The Service Provider also draws the Visitor’s attention to the necessity to check the Policies in advance.

10.7 Once the Voucher has been received by the Ticket Purchaser or the Ticket has been received by the Visitor, the Service Provider shall not be liable for any damage, destruction or loss of the Voucher or the Ticket. The Visitor shall not be entitled to make any claim or demand against the Service Provider on the grounds of the procedures applied in connection with a damaged or lost Ticket.

10.8 The Ticket Purchaser declares that the data provided by him/her during the purchase process will are provided truthfully in the context of the purchase, at the time of purchase and at all other times when required while using the services. The Service Provider excludes any liability for damages resulting from the provision of incorrect or non-functional data, email address or delivery address, but may claim compensation for any damages incurred in this respect.

10.9.The Ticket Purchaser acknowledges that the Service Provider is not liable for any damage or misuse that occurs during or as a result of the use of a payment method, including for example the case when the Ticket Purchaser has not reported the loss of his/her credit card to the financial institution that issued the card. In particular, the Service Provider shall not be liable for any errors, defects or security of the payment solution used.

10.10. The Visitor is fully liable under both civil and criminal law for any damage caused by him/her within the framework of or in connection with the Exhibition, both to the Service Provider and other contributors and contractual partners, as well as to other Visitors and third parties.

10.11 The Service Provider excludes its liability for any damage caused to any Visitor or third party by the unlawful acts or omissions of the Visitor or third parties.

10.12. The Visitor is obliged to comply with the regulations applicable on the venue and the premises of the Museum. The Visitor may not enter areas accessible from the Exhibition area which are restricted.

10.13. The Visitor is obliged to leave the venue immediately after the expiry of the time zone reserved by the Visitor for visiting the Exhibition.

10.14. Pets are not allowed in the Exhibition area, and the Service Provider is not able to ensure their accommodation,

10.15. Under these GTC claims may be enforced within a limitation period of 6 (six) months, according to Article 6:22 (3) of the Civil Code.

 

11. Complaint procedure, complaint handling, dispute resolution

11.1 The Consumer’s complaint will be recorded and investigated in accordance with the mandatory legislation, including the provisions of the Civil Code and the consumer protection legislation in force. The registered office of the Service Provider, the place of complaint handling, its postal address, e-mail address, Internet address and telephone number are specified in clause 1.1 of the GTC.

11.2 The Consumer may communicate his/her complaint to the Service Provider orally or in writing, regarding the Service Provider’s conduct, activity or omission in connection with the Contract. The Service Provider shall investigate the oral complaint immediately and, if possible, remedy it promptly. If the Consumer does not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, the Service Provider shall immediately take a record on the complaint and its position and provide the Consumer with a copy of the record, on the spot in case of an oral complaint communicated in person, or, in the case of an oral complaint communicated by telephone or other electronic communications service, at the latest at the same time as the substantive reply.

The Service Provider shall reply to the written complaint in writing within thirty days of receipt and send it to the Consumer, primarily to the e-mail address provided by the Consumer. The Service Provider shall state the reasons for its rejection of the complaint. In case of rejection of the complaint, the Service Provider shall inform the Consumer in writing of the authority or conciliation body to which he/she may refer the complaint, depending on its nature.

11.3. In order to settle a consumer dispute related to the conclusion or performance of the Contract out of court, the consumer may turn to the independent body of the county (capital city) chambers of commerce and industry, the conciliation body (Contact details of the bodies can be found at: https://bekeltetes.hu/). The competent conciliation body according to the location of the Service Provider’s registered office is called the Budapesti Békéltető Testület (Budapest conciliation body) (registered office: 1016 Budapest, Krisztina krt. 99., III. floor. 310., mailing address: 1253 Budapest, PO Box 10., e-mail address: bekelteto.testulet@bkik.hu, telephone number: 06 (1) 488 21 31.

11.4. In all other disputes relating to these GTC or the Exhibitions, as well as to the Services provided by the Service Provider, the Budapesti II. és III. Kerületi Bíróság (Budapest II and III District Court) or the Székesfehérvári Törvényszék (Székesfehérvár Tribunal) shall have exclusive jurisdiction, depending on their competence.

11.5. The Consumer’s right of withdrawal

The Service Provider informs the Consumers that they are not entitled to the right of withdrawal and termination provided for in Article 20 of the Government Decree No.45/2014 (26.II.) on the detailed rules of contracts between consumers and businesses (hereinafter referred to as the “Regulation”) pursuant to Article 29 (1) (l) of the Regulation, as the Contract in question is for a service related to leisure activities, which is valid for a specific performance date (Exhibition date).

If the Ticket Purchaser has purchased the Ticket from the contractual partners of the Service Provider selling the Ticket, the (general) terms and conditions of the Ticket seller shall apply to the exercise of the right of withdrawal or termination.

11.6. The Ticket Purchaser acknowledges that if he/she is unable to attend the exhibition for reasons of his/her own sphere of interest, the Service Provider cannot refund the price of the Ticket.

 

12. Use of trademarks, logos

12.1. The trademarks, logos and other information and materials appearing on the Service Provider’s Websites, in online and offline media and at the Exhibition are the exclusive property of the Service Provider, its contributors and contractual partners. Such signs may not be used, copied, distributed or published in any way for any commercial gain by Visitors or any other third party without the express prior written consent of the Service Provider’s contributors or contractors.

12.2 Trademarks, logos and other information and materials are protected by industrial property rights and copyright, and the rights thereto belong to the Service Provider, its agents, contributors and contractual partners.

12.3 The Service Provider shall have the unlimited and exclusive right to use any comments, suggestions or ideas communicated by the Ticket Purchaser, Ticket Holder or Visitor to the Service Provider, its contributors and contractual partners in connection with or during the Exhibitions. The Service Provider shall become the exclusive owner of all such rights in the comments and shall not be restricted in any way in their use. The Service Provider shall be entitled to exploit, use, reproduce, disclose, adapt, publish, communicate to the public and distribute the Comments without limitation and without any consideration to be offered.

 

13. Force Majeure

13.1 The Service Provider shall not be liable for the total or partial non-performance of its obligations under the contract in the event of external “c” events beyond its control. The term “Force Majeure” shall be understood to mean any unforeseeable event occurring after the conclusion of the contract and independent of the Service Provider, such as: storms with lightnings, war, riots, disasters, floods, traffic disruptions, strikes, epidemics or any resulting official measures.

13.2 If the duration of the effect of the “Force Majeure” exceeds 5 days, both the Service Provider and the Ticket Purchaser shall be entitled to terminate the contract for the given products with immediate effect, without any liability for damages resulting from the termination of the contract due to the occurrence of the “Force Majeure” circumstance. In the above case, the Parties shall bear their own damages, and the Ticket Purchaser shall not be entitled to reimbursement of any amounts paid to the Service Provider.

 

14. Protection of personal data

14.1 The Service Provider’s Privacy Notice on the processing of personal data is available at

15. Making recordings

15.1 The Visitor acknowledges that audio and video recordings may be made at the Exhibition in order to be used by the Service Provider on its Website and social media platforms to capture the best moments of the Exhibition and to promote the Exhibition. The recordings may be crowd shots or shots of small groups. In case of crowd shots, no photographs are taken directly and specifically of the persons concerned, i.e. in this case the shots are not explicitly intended to portray the participants as individuals, but only as part of the crowd. In the case of crowd shots, the legal basis for the taking of the shots is Article 2:48(2).

15.2 If a small group of Visitors, or in exceptional cases individual data subjects, is to be recorded, this will be clearly indicated before the recording is made. The spa environment is not suitable for our photographers to approach the data subject to sign a consent form. However, the person concerned always has the right to object to the taking of the photo. If this does not happen, but on the contrary, the data subject looks into the camera, smiles, waves or poses for the taking of the photo, it is treated as a clear consent of the data subject to the taking of the photo and its use, pursuant to Article 2:48 (1) of the Civil Code.

15.3 Visitors are not entitled to record the Exhibition, no photo or video recordings may be made of it.

 

16. Other provisions

16.1 When concluding contracts with the Consumer and performing them, the Service Provider shall comply with all mandatory legal requirements. The Service Provider shall not be subject to the Code of Conduct under the Act on the Prohibition of Unfair Commercial Practices against Consumers.

16.2 If, as a result of a decision of a competent court or changes in the law, any provision of these GTC becomes invalid or ineffective, the acknowledgement or occurrence of such invalidity or ineffectiveness shall not invalidate or render ineffective any other provision of these GTC. If any provision of these GTC shall become permanently illegal or invalid, such provision shall cease to be part of these GTC, but all other provisions shall remain in full force and effect and such provisions shall be replaced by provisions with similar meanings which reflect the original intent of those provisions, to the extent permitted by applicable law.

16.3 These GTC shall enter into force upon publication and shall remain in force until the date on which the Service Provider publishes any amendments to these GTC on its Website, with immediate effect upon publication on the Service Provider’s Website.
